is the music for this game exclusive to pirate galaxy?

I have noticed that the music for commerce central combat is being used for a trailer for a game that is coming out called (remove this if you think its advertising, but it is not meant to be) DarkStar One - Broken Alliance for xbox 360. I was wondering if the composer for this game is working for / allowing them to use the music as well as using it for pirate galaxy? thanks.

Our CEO knows the guy who composed the music for darkstar-1 and bought the rights to use it with PG.
